Terms and Conditions

Real Estate Photography Terms of Service Agreement

By booking, purchasing, scheduling, or using services provided by AeroThunder Media (“Company,” “Photographer,” “we,” “our,” or “us”), the client (“Client,” “Agent,” “Broker,” “Property Owner,” or “you”) agrees to the following Terms of Service and Photography Services Agreement.

1. Scope of Services

AeroThunder Media provides professional real estate media services including, but not limited to:

  • Aerial drone photography
  • Interior and exterior photography
  • Ground-level photography
  • Video production
  • Floor plans
  • Virtual tours
  • MLS-ready media formatting
  • Property marketing media

Specific deliverables, turnaround times, and included services are determined by the package selected by the Client at checkout or booking.

2. Package Descriptions

Aerial Essentials Package

Tagline: Fast, high-impact real estate listings

Description

Our most affordable entry-level package is perfect for quick Ventura listings that still want strong aerial impact. You’ll receive 10 edited aerial still photos, 20 edited interior and ground-level photos, 15 raw aerial selects, and a 30-second aerial video. Includes a 2D floor plan and MLS-formatted photo package. Turnaround is 3 business days, with rush delivery available for $75.

3. Pricing & Payment Terms

Deposits

A non-refundable booking deposit may be required to reserve a shoot date.

Applicable deposits:

  • Starter Package Deposit: $82.25
  • Standard Package Deposit: $137.25
  • Pro Package Deposit: $212.25
  • Premium Package Deposit: $324.75

Bookings are not confirmed until the required deposit has been received.

Remaining Balance

Remaining balances are due according to the selected package terms and may become payable:

  • Prior to media delivery
  • On the day of the shoot
  • Upon invoice issuance
  • As otherwise specified during booking

Failure to pay outstanding balances may result in delayed delivery, suspended licensing rights, or collections action.

Late Payments

Invoices unpaid after seven (7) calendar days may accrue a late fee of 1.5% per month or the maximum amount permitted by law.

4. Scheduling & Property Readiness

The Client is responsible for ensuring that the property is fully prepared before the scheduled shoot time.

This includes:

  • Cleaning and staging
  • Removing vehicles
  • Securing pets
  • Turning on utilities
  • Ensuring accessibility
  • Obtaining any required permissions or HOA approvals

Time spent waiting for property preparation may reduce available shooting time or require rescheduling fees.

AeroThunder Media is not responsible for unfavorable property appearance caused by incomplete preparation.

5. Weather & Flight Restrictions

Drone operations are subject to:

  • FAA regulations
  • Airspace restrictions
  • Temporary Flight Restrictions (TFRs)
  • Weather conditions
  • Wind conditions
  • Rain or visibility limitations
  • Safety considerations

AeroThunder Media reserves the right to postpone or cancel aerial operations if conditions are unsafe or legally restricted.

If drone operations become impossible due to external restrictions, the Company may:

  • Substitute ground photography
  • Reschedule the aerial portion
  • Provide partial refunds at its discretion

FAA compliance documentation may be provided where applicable:

  • Starter: FAA Part 107 Remote Pilot Certificate + FAA UAS Registration
  • Standard: FAA-compliant flight log provided
  • Pro: FAA Part 107 Remote Pilot Certificate + FAA UAS Registration
  • Premium: FAA Part 107 Remote Pilot Certificate + FAA UAS Registration

6. Turnaround & Delivery

Estimated turnaround times:

  • Starter Package: 3 business days
  • Standard Package: 2 business days
  • Pro Package: 2 business days
  • Premium Package: 1 business days

Delivery timelines are estimates and may vary due to:

  • Weather delays
  • Editing workload
  • Revisions
  • Technical issues
  • Holidays
  • Client communication delays

Final media is delivered electronically using the delivery method specified in the selected package.

The Client is responsible for downloading and backing up delivered media.

7. Revisions & Editing

Included revision rounds:

  • Starter: 1
  • Standard: 3
  • Pro: 2
  • Premium: 0

Revisions are limited to reasonable editing adjustments and do not include complete re-edits or reshoots unless otherwise agreed.

Additional revisions may incur fees:

  • Starter additional revision fee: $75
  • Standard additional revision fee: $0
  • Pro additional revision fee: $0
  • Premium additional revision fee: $0

All editing style decisions remain at the artistic discretion of AeroThunder Media.

8. Rescheduling & Cancellation

Rescheduling fees may apply:

  • Starter: $50
  • Standard: $0
  • Pro: $50
  • Premium: $0

Cancellations within twenty-four (24) hours of the scheduled appointment may result in forfeiture of deposits.

Weather-related reschedules initiated by AeroThunder Media will not incur additional fees.

9. Licensing & Usage Rights

All photographs, videos, media files, edits, and deliverables remain the sole intellectual property of AeroThunder Media unless otherwise agreed in writing.

The Client receives a limited, non-transferable usage license according to the selected package.

Permitted uses may include:

  • MLS listings
  • Real estate marketing
  • Social media
  • Brokerage websites
  • Print marketing
  • Third-party syndication platforms

Licensing permissions vary by package:

  • Starter: MLS / real estate listing use; Client website / social media use
  • Standard: MLS / real estate listing, Social media, Website/marketing
  • Pro: MLS / real estate listing use; Client website / social media use; Third-party syndication (Zillow, Realtor.com, etc.)
  • Premium: MLS / real estate listing use; Client website / social media use; Print marketing materials; Third-party syndication (Zillow, Realtor.com, etc.); Paid advertising campaigns

Unless explicitly licensed:

  • Media may not be sold to third parties
  • Media may not be transferred to builders, stagers, designers, or other vendors
  • Media may not be used for paid advertising campaigns
  • Media may not be altered beyond standard cropping or resizing
  • Raw files are not included

Raw file licensing fees:

  • Starter: $150
  • Standard: $125
  • Pro: $150
  • Premium: $150

Unauthorized use automatically terminates all granted licenses.

10. Copyright & Portfolio Usage

AeroThunder Media retains full copyright ownership of all created media.

The Company reserves the right to:

  • Display media in portfolios
  • Use media for marketing
  • Publish media on websites or social platforms
  • Submit media for promotional or editorial use

The Client represents that they possess authority to permit photography of the property.

Requests for confidentiality or non-disclosure must be submitted in writing before the shoot and may require additional fees.

11. Limitation of Liability

AeroThunder Media shall not be liable for:

  • Missed marketing opportunities
  • MLS listing delays
  • Weather-related issues
  • Airspace restrictions
  • Technical malfunctions
  • Property access problems
  • Third-party platform errors
  • Indirect or consequential damages

Maximum liability shall not exceed the total amount paid by the Client for the affected services.

12. Property & Safety Conditions

The Client agrees to disclose:

  • Hazardous conditions
  • Aggressive animals
  • Unsafe structures
  • Construction hazards
  • Legal restrictions
  • Occupancy issues

AeroThunder Media reserves the right to refuse or terminate services if conditions are unsafe or unlawful.

13. Independent Contractor Status

AeroThunder Media operates as an independent contractor and is not an employee, broker, or representative of the Client.

14. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including:

  • Severe weather
  • Natural disasters
  • Government restrictions
  • FAA restrictions
  • Internet outages
  • Equipment failure
  • Labor disruptions
  • Emergencies

15. Governing Law

This Agreement shall be governed by the laws of the State of California without regard to conflict-of-law principles.

Any disputes arising under this Agreement shall be resolved in the appropriate courts located within California.

16. Acceptance of Terms

By booking services, paying an invoice, electronically signing, checking an acceptance box, or otherwise engaging AeroThunder Media, the Client acknowledges that they have read, understood, and agreed to these Terms of Service in full.
